1. This website is published and maintained by Fintan Damer. Your use of the website is subject to a legally binding agreement between you and Fintan Damer. (the “Agreement”). The following are the terms of the Agreement (the “Terms”). By using the Site you acknowledge that you have read, understood and agreed to the Terms and all related documents. It is important that you read them carefully. If you do not agree to the Terms and all related documents, you should not continue to use the Site or the services it provides.

2. Any software that is downloaded from this site or recommended by this site is used entirely at your own discretion. Sufficient knowledge of the software is assumed in order for you to be able to submit an accurate sketch of your garden for design work to be completed with precision.

3. Any hand drawn or scanned sketches of your garden  submitted by you are assumed to have been drawn accurately by you, and by inference inaccuracies in the garden design work you receive from thegardendesigner.ie (from her on known as “The site”) or from Fintan Damer (from here on known as “The Designer”) are entirely at your own risk. You are advised to double check your measurements and details once your sketch is complete, and before submitting it for garden design work to commence.

4. You acknowledge and agree that all intellectual property rights (including, but not limited to, copyright, patents, know-how, confidential information, database rights, and rights in trademarks and designs whether registered or unregistered) vested in the site are also vested in the company.

5. The site and by inference the designer, reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement in whole or in part, at any time and without giving prior notice. Changes in this Agreement will be effective when posted on the Site. Your continued use of the Site after any change to this Agreement is posted will be considered acceptance of those changes.

6. Your details including contact details and details of your garden are confidential and will not be shared with any other company or third party except specifically for the creation and completion of your garden design(s).

7. All design work remains wholly the property of the site until full payment has been received. Intellectual property such as know-how, artistic works and design skills remain in the ownership of the company even after full payment has been received. This right is covered under intellectual property rights law. Reproduction of these garden designs in part or full is prohibited except specifically for the implementation of the design in your garden space.

8. The site authorises you to view and download the information ("Materials") on the Site only for your personal, non-commercial use, unless otherwise expressly stated. This authorisation is not a transfer of title in the Materials and is subject to the restriction that you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use or communicate them for any public or commercial purpose.
